Map the transaction before generating the agreement
Identify the seller, buyer, item, current title or ownership jurisdiction, intended destination and physical handoff location. For a vehicle, compare the VIN, title name, lien information and odometer facts before drafting the agreement. Cross-state facts matter because more than one state’s rules or agency procedures may be relevant.
Decide which information belongs in the private agreement and which must be completed through an official form or system. A Signeret questionnaire can record the negotiated facts, but it should not invent a universal answer for title transfer, tax, registration, plates, insurance, notarization, witness or odometer procedure.
Show one complete version and capture a deliberate signature
Each party should be able to review the same final text, correct errors and understand their role before signing. The signature action should clearly express intent to adopt that version and consent to the electronic workflow. Names, price, disclosures, condition notes, state context and handoff terms should not be changed after signature without a new review and signature.
US law does not require the eIDAS simple, advanced or qualified labels. The evidence instead should explain the actual method: the personal link, displayed document version, confirmation action, time, recipient path and any retained integrity information. Those signals support attribution but do not establish government identity, ownership, authority or capacity by themselves.
Deliver and retain an accurate final record
After both signatures, provide the parties with an accurate, reproducible final PDF and retain the connection between that record and the signature events. Keep version and event data in a form that can later show what was agreed, rather than regenerating a potentially different document from mutable questionnaire answers.
The parties should retain the completed PDF with payment confirmation, listing and messages, condition photographs, title copies, lien release, odometer record and receipts from official filings. E-SIGN addresses access and accurate reproduction when a law requires retention, while applicable state law and the specific record may add requirements.
Complete title and agency work outside the private contract
A signed private PDF does not itself transfer a government title, register the vehicle, report tax, release a lien or update a DMV record. Depending on the transaction, a state may require a prescribed bill of sale, paper title, original signature, odometer disclosure, notarization, witness, inspection, insurance evidence or separate seller notice. E-SIGN also has statutory exclusions.
Use the current official instructions for every relevant state and agency. If an official form requires wet ink, notarization, a witness or an original document, complete that requirement exactly as directed. Do not label the Signeret evidence trail as notarization, official filing or guaranteed compliance.
Treat exceptions and uncertainty as visible work
Rules vary by state and transaction type. When a required step is uncertain, record it as unresolved and pause the affected transfer step rather than hiding the issue behind a general electronic-signature statement. A private agreement may still be useful evidence even when another form must also be signed, but the two documents have different jobs.
